1. About these terms
These Terms of Service ("Terms") govern your use of the Hinterflow platform operated by Hinterflow Pty Ltd ("Hinterflow", "we", "us"). By accessing or using Hinterflow, you agree to be bound by these Terms.
If you are using Hinterflow on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms, and references to "you" include that organisation.
These Terms should be read together with our Privacy Policy, which forms part of this agreement.
2. What Hinterflow does
Hinterflow is a professional productivity platform that:
- Records and transcribes voice sessions in real time using AI
- Uses AI to extract structured data from transcripts and map it to form fields
- Provides tools to push extracted, reviewed data into third-party web forms
Hinterflow does not submit, lodge, or execute any form or application on your behalf. All final review, verification, and submission is your responsibility. Hinterflow is a data entry assistance tool — not a decision-maker, not a registered health service, and not an authorised lodgement agent.
3. Eligibility and professional use
Hinterflow is intended for use by professionals conducting structured conversations that end in form-filling — for example, aged care assessors, NDIS planners, allied health professionals, financial advisers, insurance brokers, recruiters, and similar roles. By using Hinterflow, you represent that:
- You are at least 18 years old
- You are using Hinterflow in a professional or organisational capacity
- Your use complies with your professional registration obligations, employer policies, and applicable law
- Where your use involves recording another person, you have appropriate authority to handle their personal information (including any health information disclosed)
4. Consent obligations when recording another person
If you use Hinterflow in a way that records another person — for example, an interview, consultation, or assessment conversation — you must:
- Inform them that the conversation is being recorded and transcribed using AI
- Inform them that AI systems will assist with the conversation and form-filling (all processing runs on infrastructure in Australia)
- Obtain their informed consent before starting the session
- Document that consent in accordance with your organisation's procedures and applicable law
You must not record another person through Hinterflow without their knowledge and consent. We are not responsible for any failure by you to obtain appropriate consent, and you indemnify us against any claim arising from such failure.
5. Your responsibilities
- You are responsible for the accuracy and completeness of any form you complete using Hinterflow output.
- You must review all AI-extracted data before using it in any official form, system, or submission.
- You must not use Hinterflow for any unlawful purpose or in breach of any regulation applicable to your work.
- You must keep your account credentials confidential and notify us immediately at hello@hinterflow.com if you become aware of any unauthorised access to your account.
- You are responsible for ensuring that your use of Hinterflow complies with the terms and conditions of any third-party portal or system you use it with.
6. Acceptable use
You may use Hinterflow for legitimate professional work. You must not:
- Use Hinterflow to generate, fabricate, or submit fraudulent forms, claims, or applications
- Use Hinterflow to record another person without their consent
- Attempt to reverse-engineer, scrape, or interfere with the Hinterflow platform
- Share your account with individuals who are not authorised users within your organisation
- Use Hinterflow in a way that violates any applicable privacy legislation, professional standards, or your employer's policies
We reserve the right to suspend or terminate accounts that we reasonably believe are being used in breach of these Terms.
7. AI processing and accuracy
Hinterflow uses AI models for voice transcription and data extraction. These models are capable but not infallible — they can misinterpret speech, produce transcription errors, or extract data incorrectly. You must independently review all AI output before it is used in any form, application, or submission.
Hinterflow Pty Ltd is not responsible for any error, omission, or inaccuracy in AI-generated output that you use without independent review.
8. Your data
You own your data. By using Hinterflow, you grant us a limited, non-exclusive licence to process your data solely for the purpose of providing the service. We do not claim ownership of your transcripts, extracted data, or session content.
Storage in Australia
All account data, transcripts, and extracted form data are stored in Australia on AWS infrastructure in the Sydney region (ap-southeast-2). Data at rest does not leave Australia.
AI inference in Australia
Voice transcription and AI field extraction run on AWS infrastructure in the Sydney region (ap-southeast-2). No customer data leaves Australia at any point — at rest, in transit, or during AI processing. Processing is transient: data is sent for inference, the result is returned, and nothing is retained by AWS for any other purpose. See our Privacy Policy for full details.
No AI training on your data
We do not use your session data — transcripts, extracted fields, or voice audio — to train AI models, whether our own or those of any third party.
9. Intellectual property
The Hinterflow platform, including its software, design, and underlying technology, is owned by Hinterflow Pty Ltd and protected by intellectual property laws. Your licence to use the platform does not include any right to copy, modify, distribute, or create derivative works from any part of it.
You retain all intellectual property rights in your content — transcripts, extracted data, and any other information you upload or generate through the platform.
10. Fees and billing
Pricing is as agreed between you and Hinterflow Pty Ltd at the time of account creation or as set out in a separate order or subscription agreement. We will provide reasonable notice of any pricing changes. Continued use after a pricing change takes effect constitutes acceptance of the new pricing.
All fees are quoted in Australian dollars and are exclusive of GST unless otherwise stated.
11. Availability and changes
We aim to provide a reliable service but do not guarantee uninterrupted availability. We may update, modify, or discontinue features with reasonable notice. Planned maintenance will be communicated in advance where practicable.
We may update these Terms from time to time. We will notify registered users of material changes by email at least 14 days before they take effect. Continued use after changes take effect constitutes acceptance of the updated Terms.
12. Limitation of liability
To the maximum extent permitted by law, Hinterflow Pty Ltd's total liability to you for any claim arising out of or relating to these Terms or your use of the platform is limited to the amount you paid us in the twelve months preceding the claim.
We are not liable for any indirect, incidental, consequential, or special damages, including:
- Errors or inaccuracies in AI-extracted data that you used without independent review
- Any consequence arising from your failure to obtain consent from another person you recorded
- Loss of data due to circumstances outside our reasonable control
- Any decision made in reliance on Hinterflow output
Nothing in these Terms limits liability that cannot be excluded by law, including liability under the Australian Consumer Law for major failures.
13. Indemnification
You agree to indemnify and hold harmless Hinterflow Pty Ltd, its officers, employees, and agents from any claim, damage, loss, or expense (including legal costs) arising from:
- Your breach of these Terms
- Your failure to obtain informed consent from another person before recording them through Hinterflow
- Your use of AI-extracted data without independent review
- Your violation of any applicable law or regulation in connection with your use of Hinterflow
14. Termination
You may close your account at any time. We may suspend or terminate your access if you breach these Terms, for non-payment, or for any other reasonable cause with notice where practicable.
Upon termination, your data will be handled as described in our Privacy Policy. You may request an export of your data before termination.
15. Governing law
These Terms are governed by the laws of Victoria, Australia. Any disputes arising under or in connection with these Terms will be subject to the non-exclusive jurisdiction of the courts of Victoria.
